Terms of Service

These Terms of Service (“Terms”) govern your use of the Perch iOS app (“Perch”, “the app”), provided by Brandon Briggs (“we”, “us”, “our”). By downloading or using Perch, you agree to these Terms. If you do not agree, do not use the app.

Health notice: Perch is a general wellness and posture-awareness tool. It is not a medical device and does not diagnose, treat, cure, or prevent any condition. It does not provide medical advice. Consult a qualified healthcare professional before making changes based on the app, and stop using it if you experience pain or discomfort.

1. What Perch does

Perch uses head-motion data from motion-capable AirPods to estimate your posture and gently nudge you — by lowering your other audio and playing a soft tone — when you slouch. Perch depends on your AirPods and device hardware and may not detect every posture change accurately.

Any information Perch provides is for general informational and wellness purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Never disregard or delay seeking professional advice because of something in the app. You use Perch at your own risk.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your region) to use Perch. If you are under the age of majority, you must have permission from a parent or guardian.

4. License and acceptable use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Perch for your own personal, non-commercial use, subject to these Terms and the App Store terms. You agree not to:

Perch offers auto-renewable subscriptions (for example, weekly and yearly plans, and promotional offers). The current prices and any free-trial terms are shown in the app before you purchase. The following apply:

6. Intellectual property

Perch and its content, design, and trademarks are owned by us and our licensors and are protected by law. Except for the license granted above, these Terms do not transfer any rights to you.

7. Apple and third parties

The App Store and payment processing are provided by Apple and governed by Apple’s terms, including the standard Licensed Application End User License Agreement. Apple is not responsible for the app or its content and is not a party to these Terms, but Apple and its subsidiaries are third-party beneficiaries with the right to enforce these Terms against you.

8. Disclaimer of warranties

Perch is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will accurately detect posture.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of (or inability to use) Perch. To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the app in the 12 months before the claim.

10. Changes to the app and these Terms

We may update, change, or discontinue features of the app, and we may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of Perch after changes take effect constitutes acceptance of the revised Terms.

11. Termination

These Terms remain in effect while you use Perch. We may suspend or terminate your access if you breach these Terms. You may stop using Perch at any time by deleting it from your device; sections that by their nature should survive (such as disclaimers and limitation of liability) will survive termination.

12. Governing law

These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the state or federal courts located in Maryland, unless applicable law requires otherwise.
